PSA-0721/C.R.174/Spl.4.- In exercise of the powers conferred by section 25 of the Private Security Agencies (Regulation) Act, 2005 (Act No. 29 of 2005) in relation to the State of Maharashtra and its application to the State of Maharashtra Private encroachment of security agencies (Regulation) Rules, 2007, notwithstanding anything done or omitted to be done before such supersession, the Government of Maharashtra hereby makes the following rules, namely:—
- Short title and commencement.- (1) These rules may be called the Maharashtra
Private Security Agencies (Regulation) Rules, 2022.
(2) They shall come into force from the date of their publication in the Official Gazette. - Definitions.—(1) In these rules, unless the context otherwise requires,—
(a) “Act” means the Private Security Agencies (Regulation) Act, 2005 (29 of 2005);
(b) “agency” means a private security agency;
(c) “controlling authority” shall have the meaning assigned to it in clause (b)
Section 2 of the Act;
(d) “form” means a form appended to these rules;
(e) “license” means a license granted under the Act;
(2) Words and expressions used but not defined in these rules shall have the same meaning respectively assigned to them in the Act.
- Application for grant of license.- (1) Every agency while applying in Form I to the Controlling Authority for grant of license shall also enclose Form II for verification of its antecedents.
(2) If the applicant is a company, firm, or association of persons, the application in Form I shall be accompanied by Form II for each owner or majority shareholder, partner, or director.
The company, as if they were also applicants. In addition, he shall also submit an affidavit in the form
Containing particulars in respect of the provisions contained in sub-section (2) of section 7 of III
Act.
(3) On receipt of Form I, Form II, and Form III, the controlling authority shall inquire, as it considers necessary to verify the contents and particulars of the application Applicant.
(4) On receipt of an application for a license, the Controlling Authority shall send a copy of the application to For antecedents of the applicant, partners, owner, majority stakeholders, or directors of the company For verification of the premises, to the District Superintendent of Police of the concerned district or The Deputy Commissioner of Police in charge of the zone in the Commissionerate area, in which The agency intends to commence its activities.
(5) The Controlling Authority may also use the electronic database of crime and criminals Crime and Criminal Tracking Network and Systems (CCTNS), Interoperable Criminal Justice system for the purpose of verification of antecedents of the applicant (ICJS), etc.
Antecedent report from the Superintendent of Police or Deputy Commissioner of the concerned district Police in charge of the Zone in the Commissionerate area, as the case may be.
(6) Where an applicant’s antecedents have been previously verified and licensed in any other State granted, it shall not be necessary for the Controlling Authority to verify the antecedents afresh.
Provided that the license for which the antecedents have been verified is within the period of validity.
(7) Form I shall be accompanied by a demand draft or banker’s check or electronic evidence showing payment of the fee prescribed under sub-section (3) of section 7 of the Act, is due Controlling authority of the concerned State where the application is being made.
(8) The application referred to in sub-rule (1) shall be made in person either by controlling authority or sent to him by registered post or electronic means.
(9) On receipt of the application referred to in sub-rule (1), the Controlling Authority shall Provide electronic or digital grants, after marking thereon the date of receipt of the application Acknowledgment to the applicant.
(10) The Controlling Authority shall, after receiving an application in Form I, grant the license to the private security agency after making such inquiries in Form IV as it may consider necessary, and After complying with the provisions of the Act:
