New Jersey Power of Attorney allows a person (known as the “Principal”) to select someone else (known as the “Agent” or “Attorney-in-Fact”) to maintain authority over their financial matters, health care decisions, and other personal and/or business affairs.
There may be a point in a person’s life where they feel they want to hand over certain powers concerning their personal or business life to a trusted individual.
Having a power of attorney in place means that the agent can perform certain tasks for the principal and, in some cases, this power will continue even if something happens to the principal (mental or physical disability or another type of incapacitation).
The principal should be rational when making their selection; an attorney-in-fact must be trustworthy, competent, and responsible.
To set up a power of attorney, both the agent and principal need to fill out and sign a power of attorney form.
Powers of attorney are regulated by NJ Rev Stat § 46:2B, while health care proxies (New Jersey power of attorney for health care) must be executed according to NJ Rev Stat §26:2H-53 to §26:2H-67.

New Jersey Power of Attorney Requirements
Your power of attorney form will be legally binding in New Jersey if it’s executed according to NJ Rev Stat § 46:2B. Make sure your power of attorney meets all NJ requirements:
The power of attorney form must include the:
name and contact information of the principal and agent(s)
date of execution
powers are given to the agent, described in clear language
the effective date of the agent’s powers
termination of the agent’s powers
signatures of the principal, agent, and notary
The principal’s signature must be acknowledged before a notary public
A durable power of attorney must contain specific language indicating that the agent’s powers will not be revoked if the principal becomes incapacitated.
If you appoint multiple co-agents, you should indicate whether they will act jointly or separately to make decisions on your behalf.
If you don’t specify in the form, your agents will have to agree on every decision made on your behalf.
