5 Day Eviction Notice
A five (5) day’s notice to quit is a form used to notify a tenant that they are in non-compliance with their residential lease due to a violation.
The most popular is not paying rent on time, although the reason can be for any violation such as parking in the wrong area, damage to the premises or common areas, or any other condition that has been broken by the tenant.
The form is typically given in person, through certified mail, or left in a conspicuous place on the resident’s property.
What is an Eviction Notice?
An eviction notice ( or an eviction letter ) is a legal document used by a landlord to evict a tenant for not complying with the original terms of the lease or rental agreement.
In some cases, the landlord may believe the problem is not fixable and send what’s known as an incurable eviction notice.
In the case of an incurable eviction notice, the tenant has no choice but to vacate the property within a certain number of days.
Even if the landlord serves an eviction notice, the tenant has the right to stay on the premises until a judge hears from the landlord and tenant.

According to the respective State laws, the following require a five (5) day’s notice for various infractions against their lease:

How to Write
Before sending the notice, make sure you know which type of infraction you are informing the tenant of and whether it requires five (5) days’ notice.
The most common types are late payment, non-compliance, or illegal activity conducted on the property.
Step 1 – Download the five (5) day notice to quit in Adobe PDF, Microsoft Word (.docx) , or OpenDocument Text (.odt) and begin to fill in by entering:
First Section – Enter the name of the tenant(s) on the lease agreement along with the street address (include City, State, & Zip Code) followed by the date when the contract was signed between the landlord and tenant.
Step 2 – In the violation, section check the box that best describes the infraction enacted by the tenant:
Late Rent – Enter the person who will ask for the funds if the tenant pays within the time period.
Also, make sure to include the final amount with any late fees and the periods for which they have not paid.
Non-Compliance – If the tenant has broken the terms of their rental contract it should be described and the landlord/agent will inspect within the notice period to ensure the property is back in compliance.
Illegal Activity – If the landlord has committed an unlawful act it should be detailed in this section and the tenant will have no choice but to vacate the premises at the end of the five (5) days.
Step 3 – The landlord should sign the document at the bottom of the page and then decide which option to best send the notice to the tenant:
Delivering the document in person to the tenant;
Delivering the document in person or with a person that is a resident on the property of legal age to accept notice in the State.
If this option is selected a copy must additionally be sent to the tenant via Certified Mail (in most States);
Certified Mail (return receipt) to the tenant.
The notice period shall begin upon receipt of the document by the tenant.
